New trial ordered for former Highmore police chief

SIOUX FALLS, S.D. (AP) - The South Dakota Supreme Court has

ordered a new trial for Ken Huber, a former police chief convicted

of killing his wife at their Highmore home.

The court said in an opinion issued Thursday that the judge

erred by not allowing Huber's attorneys to call a witness to

testify how the shooting could have been accidental.

Huber told investigators his pistol fired accidentally as he

moved it from a bedroom dresser to a gun safe. Pam Huber was shot

once in the forehead in October 2007 and died several days later in

a hospital.

Huber was sentenced to life in prison for first-degree murder.
